Terms of Service

1. About Us
TableNest is operated by Fyrge Lab Pty Ltd (ACN 696 775 096), an Australian company. In these terms, “we”, “us”, and “our” refer to Fyrge Lab Pty Ltd, and “Service” refers to the TableNest platform including the website, dashboard, booking widget, APIs, and related tools.
2. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
3. Service Description
TableNest provides an online table reservation and booking management system for restaurants, cafes, and other hospitality venues. The Service includes an embeddable booking widget, management dashboard, SMS and email notifications, calendar views, waitlist management, and related tools. We do not guarantee uninterrupted availability and may perform maintenance as needed.
4. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
5. Free Trial
New accounts receive a 30-day free trial of their selected plan with full access to all features included in that plan. A valid credit or debit card is required to activate a trial. Your payment method will not be charged during the 30-day trial period. If you do not cancel before the trial ends, the payment method on file will be automatically charged for your selected plan at the then-current rate (monthly or annual, as selected). You may cancel at any time during or after the trial via the billing portal in your dashboard; if you cancel during the trial, no charge will be made. If your subscription lapses or is cancelled, your access to the dashboard will be suspended, but your data will be retained for 90 days. You may reactivate your account at any time during this period by subscribing to a plan.
6. Pricing and Payments
Paid plans are available in monthly and annual billing cycles. Prices are listed in Australian Dollars (AUD) and US Dollars (USD) on our pricing page. All payments are processed securely by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel. We may change pricing with 30 days’ notice via email. Price changes do not apply to your current billing cycle.
SMS top-up packs (additional booking credits) are available as one-time purchases and are non-recurring. Top-up credits are valid for the current billing month and do not roll over.
7. Refund Policy
Subscription fees are generally non-refundable. However, if you are unsatisfied with the Service within the first 30 days of your initial paid subscription (after the free trial), you may request a full refund by contacting us at support@tablenest.app. We will process refunds within 10 business days. After 30 days, no refunds will be issued for remaining time on your subscription. SMS top-up pack purchases are non-refundable once credits have been used.
Refunds required by Australian Consumer Law will always be honoured regardless of this policy.
8. Disputes
If you believe you have been incorrectly charged, please contact us at support@tablenest.app within 60 days of the charge. We will investigate and respond within 5 business days. If we cannot resolve the dispute to your satisfaction, you may escalate through your payment provider or contact the Australian Competition and Consumer Commission (ACCC).
9. Cancellation
You may cancel your subscription at any time from the billing page in your dashboard or via the Stripe billing portal. Upon cancellation, you retain access to all features until the end of your current billing period. After that, your access to the dashboard will be suspended. Your data will be retained for 90 days after cancellation, after which it may be permanently deleted. You may resubscribe at any time to restore access.
We may terminate your account if you violate these terms, engage in abusive behaviour, or use the Service for unlawful purposes. In such cases, no refund will be provided.
10. Promotional Offers
We may offer promotional codes that provide temporary access to higher-tier plans or discounts. Promotional offers are subject to the following terms: each code can only be used once per venue; codes have an expiration date after which they cannot be redeemed; promotional plan access is temporary and reverts to your base plan when the promotion period ends; we reserve the right to revoke promotional codes that are obtained fraudulently or in violation of these terms.
11. Acceptable Use
You agree not to: use the Service for any unlawful purpose; send spam or unsolicited communications through our SMS or email systems; attempt to access other users’ accounts or data; reverse-engineer, decompile, or disassemble the Service; or use automated tools to scrape, overload, or interfere with the Service.
12. Limitation of Liability
To the maximum extent permitted by Australian law, Fyrge Lab Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim. Nothing in these terms limits your rights under Australian Consumer Law.
13. International Users
The Service is available to users in Australia, the United States, Canada, and other jurisdictions. By using the Service from outside Australia, you consent to the transfer and processing of your data in Australia and other countries where our service providers operate.
United States users: If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as described in our Privacy Policy. You will not be discriminated against for exercising your CCPA rights. If you are a resident of other US states with consumer privacy laws (including Virginia, Colorado, Connecticut, and Utah), you may have similar rights — see our Privacy Policy for details.
14. Governing Law
These terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia. For US-based users, nothing in these terms limits your rights under applicable federal or state consumer protection laws.
15. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of material changes via email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised terms.
